Trial lawyers: America's best defense...

Trial lawyers are America’s best defense against tyranny. Trial lawyers have the courage and ability to pierce political deception and fraud. Because of this, tyrants and those sustained by tyrants hate trial lawyers. “I shall not rest,” Adolph Hitler raged, “until every German sees that it is a shameful thing to be a lawyer.”

AMERICA OPEN YOUR EYES - PROTECT OUR COURTS
9/11 was a horrible incident. Those who were responsible should be caught and punished accordingly. However, we should be careful of those who exploit the tragedy for power.

After a tragedy befell the German people, History exploited the German people's sense of Patriotism. Hitler persuaded President Hindenburg to issue a decree entitled, ""For the Protection of the People and the State."" Justified as a ""defensive measure against Communist acts of violence endangering the state,"" the decree suspended the constitutional guarantees pertaining to civil liberties: Restrictions on personal liberty, on the right of free expression of opinion, including freedom of the press; on the rights of assembly and association; and violations of the privacy of postal, telegraphic and telephonic communications; and warrants for house searches, orders for confiscations as well as restrictions on property, are also permissible beyond the legal limits otherwise prescribed.

On March 23, 1933, what has gone down in German history as the ""Enabling Act"" made Hitler dictator of Germany, freed of all legislative and constitutional constraints. Hitler also realized that in order for his vision to suceed, he would need to alleviate any checks and balances. Thus, he reorganized the judiciary. Sounds familiar ?. Under the Weimar Constitution judges were independent, subject only to the law, protected from arbitrary removal and bound at least in theory by Article 109 to safeguard equality before the law.

With public support, Hitler transferred jurisdiction over treason cases from the Supreme Court to a new People’’s Court, which soon became the most dreaded tribunal in the land. It consisted of two professional judges and five others chosen from among party officials, the S.S. and the armed forces, thus giving the latter a majority vote. There was no appeal from its decisions or sentences and usually its sessions were held in camera. Empowered, Hitler identifed anyone who opposed his views and/or agenda of treason....or potential terrorists. Thus they became subject to the special court that had evolved through public support. And the rest....as they say....is History!
